FitNessie is a lifting log for iPhone and Apple Watch, with its server and this website (together, "FitNessie"). It's operated by Iluvatar LLC, a Nevada limited liability company ("we", "us"). By using FitNessie you agree to these terms. They're written for people rather than for court; where they leave a question open, email legal@fitnessie.app and we'll answer it.
Health and safety
- FitNessie is a training log and a library of general information. It isn't medical advice, diagnosis or treatment, and it doesn't replace a doctor, physical therapist or qualified coach.
- Talk to a medical professional before you start a new training program, especially if you're pregnant, injured, recovering from surgery or have a heart, joint or other health condition.
- Lifting carries a risk of injury. Use loads you can control, use safeties or a spotter for heavy barbell work, and stop if you feel pain, dizziness or shortness of breath.
- The exercise demos are animated illustrations of one way to do each lift, built from the published sources each page cites. They're simplified, and individual bodies, equipment and coaching differ. The programs are general templates, not plans made for you, and the weight suggestions FitNessie makes are arithmetic on what you logged. You decide what you lift.
Using FitNessie
- You must be at least 13. If you're under 18, a parent or guardian must agree to these terms for you.
- Where you create a FitNessie account, keep your sign-in to yourself; you're responsible for what's done with your account. Tell us at support@fitnessie.app if you think someone else has used it.
- The app, the programs' presentation, the exercise demos, the words on this site and the FitNessie name and marks are ours or our licensors'. You may use them to train and to share links; you may not copy the demos or the site's content in bulk, or offer them as part of another product.
FitNessie Pro
- Pro is sold through Apple's App Store as a monthly or yearly subscription, or as a one-time lifetime purchase. The price, and any free trial, is shown in the app before you buy. Apple takes the payment, and Apple's terms for media services apply to it; we never see your card or Apple ID.
- Subscriptions renew automatically at the same length and price until you cancel. Cancel at least 24 hours before the end of the current period, in your Apple ID's Subscriptions settings, and you won't be charged again; Pro stays on until the period ends. A free trial turns into a paid subscription unless you cancel at least 24 hours before it ends.
- Refunds are handled by Apple under its policies (reportaproblem.apple.com). We can't issue App Store refunds ourselves.
- Lifetime means for as long as we offer FitNessie, not for any particular length of time. If we ever stop offering FitNessie, we'll give at least 90 days' notice on this site and in an app update.
- Prices may change. Apple tells subscribers before a change takes effect, and where its rules require it, asks you to agree first.
- Deleting your data or the app doesn't cancel a subscription; only cancelling with Apple does.
Claude and ChatGPT
- FitNessie can connect to an AI assistant you use: Claude, by Anthropic, or ChatGPT, by OpenAI. The connector is off until you turn it on in the app (Settings › Claude & ChatGPT) and agree to what it can do.
- Once it's on, the assistant acts on your instructions. It can read your routines, workouts, exercise history and measurements, and it can create, change and delete routines, log, change and delete workouts, and log measurements. Those changes reach your iPhone and Apple Watch like any other.
- Assistants make mistakes. Check what one changes, and treat its training advice the way you'd treat any other general advice (see Health and safety). We're not responsible for what an assistant says or does at your direction.
- Your use of Claude or ChatGPT is governed by Anthropic's or OpenAI's own terms and privacy policies.
- Turn the connector off in the app at any time. Its access ends at once.
Community programs
If you publish a program to the community library:
- You keep ownership of what you publish. You give us a worldwide, non-exclusive, royalty-free license to host, copy, display, format and distribute it in FitNessie and on fitnessie.app, and you let every FitNessie user add it to their own routines and train with it. The license lasts while the program is published; copies other lifters already added stay theirs.
- Only publish what you have the right to share. Don't copy a program's text or tables from a book, course or paid plan without permission; the structure of well-known methods is fine to describe in your own words.
- Don't publish anything unsafe, hateful, harassing, sexual, misleading or spammy; don't include links, contact details or anyone's personal information; and don't make medical claims.
- Your handle and your published programs are public. Choose a handle that doesn't impersonate anyone.
- Anyone can report a program. Several reports from established accounts hide it until we review it, and we may keep, hide or remove any program, or a handle, that breaks these rules. You can unpublish your own program at any time unless it's under review. You can block an author so their programs don't show for you.
Acceptable use
- Don't use FitNessie to break the law or to infringe anyone's rights.
- Don't try to get into another person's data or account, or into parts of the service that aren't meant for you.
- Don't scrape the app's API, overload the service or get around its limits. This website's pages, llms.txt and the markdown versions of its pages are open to crawlers as robots.txt describes.
- Don't reverse engineer the app except where the law allows it, and don't resell FitNessie or Pro.
Your data
What FitNessie stores, where, and how to export or delete it is in the Privacy Policy, and for Washington and Nevada residents the Consumer Health Data Privacy Policy. Both are part of these terms. Your training data is yours; you can export it from Settings at any time.
Changes to FitNessie
We add and change features as FitNessie develops. If we remove something Pro includes, we'll say so on this site and in the app's release notes first. If we ever shut FitNessie down, we'll give at least 90 days' notice and keep export working until the end.
Ending the agreement
You can stop using FitNessie at any time, and delete everything we hold from Settings › Delete all my data. We may suspend or close access for anyone who breaks these terms, after telling you what the problem is unless the situation doesn't allow it. Health and safety, the community license for copies others already added, the disclaimers and the limits of liability survive.
Disclaimers
FitNessie is provided as is and as available. To the extent the law allows, we make no warranty that it will be uninterrupted or error-free, that the information in it is complete or suited to you, or that any result will follow from using it.
Limitation of liability
To the extent the law allows, we're not liable for indirect, incidental, special or consequential loss, or for injury that comes from how you train, and our total liability to you for anything arising from FitNessie is limited to the greater of what you paid for Pro in the twelve months before the claim and $50. Nothing here limits liability that can't lawfully be limited, including for death or personal injury caused by our negligence where the law doesn't allow that to be limited.
You'll cover us for claims that arise from what you publish to the community library or from your breach of these terms.
Apple
These terms are between you and us, not Apple. Apple isn't responsible for FitNessie or its support, and has no obligation to maintain it. If FitNessie fails to conform to an applicable warranty, you may tell Apple, and Apple will refund the purchase price, if any; beyond that, Apple has no warranty obligation. Apple isn't responsible for claims about FitNessie, including product liability, legal compliance or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
The rest
- These terms are governed by the law of Nevada, USA, and disputes go to its courts, unless the law where you live gives you the right to bring them where you live.
- If we change these terms in a way that matters, we post the new version here with a new date at least 14 days before it takes effect. Continuing to use FitNessie after that is acceptance.
- If part of these terms is unenforceable, the rest still applies. Not enforcing a term isn't a waiver of it.
